Terms of Use at ArtSites

1. Acceptance of terms

By creating an account or using any part of ArtSites, you agree to these terms. If you are creating an account on behalf of a gallery, studio, or other organisation, you are confirming that you have the authority to accept these terms on their behalf. If something here does not sit right with you, please do not use ArtSites, and write to us first at support@artsites.me; we would rather explain a clause than lose you to silence.

2. Account registration

You need an account to build and manage a site with us. When you create one, give us a real name and an email address you actually check, because that is how we reach you about your site and your subscription. Keep your sign-in to yourself, and tell us right away if you think someone else has got hold of it. If someone helps you run your site, invite them from your account rather than sharing your sign-in: they get their own login and you can remove them at any time. What happens under your account is still yours to manage.

3. Your content

You own everything you upload: your artwork, your artist statement, your photographs, your words. We do not claim any rights to it beyond what we need to actually do the job you are paying us for: hosting it, showing it on your site, resizing it for different screens, and keeping backups. That licence ends when you delete the content or close your account, apart from the ordinary, brief tail of a routine backup rotation working its way through.

While ArtSites is still being finished, the FAQ's "About the Preview" section says exactly what that means for your data at this stage, and what to keep your own copies of.

You are responsible for making sure you have the right to use what you upload. A photograph you took of your own work is straightforward. Anything that includes someone else's copyrighted material needs their permission, not ours.

4. Acceptable use

We do not meter storage or bandwidth, and we expect ArtSites to be used for your own site and your own work. If that ever becomes a problem, we will talk to you before anything changes.

We built ArtSites for artists to show and sell their work, and we ask that you use it for that. Please do not upload content that is illegal where you or your visitors are, that infringes someone else's copyright or trademark, or that is meant to harass, threaten, or deceive. Please do not use ArtSites to send spam, to attack or scrape other sites, or to try to get into an account that is not yours.

Art sometimes includes nudity, difficult subject matter, or work that some viewers find confronting. That is not what this section is about, and we are not asking you to sanitise your work for us. This section is about conduct, not content: using ArtSites honestly and not to hurt someone. If we ever think a site has crossed that line, a person looks at it before anything happens to your account. We do not want an algorithm making that call about somebody's art.

5. Intellectual property

The ArtSites software, our templates and design presets, and the ArtSites name and logo belong to us. Using ArtSites to build your site does not give you any ownership of ArtSites itself, and you may not copy, resell, or take it apart to see how it works. This is the mirror of the section above: your art is yours, our software is ours, and neither of us is claiming the other's.

6. Subscriptions and billing

Pro and Group plans are paid subscriptions. Pro is $15/month or $150/year; Group is $250/year. You always see the exact price and confirm it before anything is charged. We never charge you without showing the amount first. Every new account begins with a free 10-day trial of Pro, and no card is required to start it.

Renewal. Monthly plans renew automatically each month until you cancel. Annual plans do not auto-renew on a stored card; we remind you before your year ends so you can choose to renew.

Cancelling. You can cancel any time. It is as easy as signing up, and the option is never hidden. To cancel, open the Plan page in your account, or email us at support@artsites.me. Your Pro plan stays active until the end of the period you have already paid for; we do not charge you again after you cancel, and we do not bill you for time you did not use. When the paid period ends, your site simply moves back to the free plan. Nothing is deleted. Your artwork, pages, and content are kept, and you can resubscribe at any time to bring your full site back.

Refunds. If you are ever charged by mistake, contact us at support@artsites.me and we will put it right.

7. Service availability

We work to keep ArtSites fast and available, and we watch it closely. Like any online service, we cannot promise it will never go down: hosting providers have outages, and even careful maintenance sometimes needs a short window offline. When we plan maintenance that will interrupt your site, we try to schedule it for a quiet time and, where we can, let you know beforehand. We do not currently offer a formal uptime guarantee or automatic credit for downtime, but if an outage on our end costs you something real, write to us at support@artsites.me; we will look at it honestly rather than pointing you to a clause.

8. Termination

You can stop paying and take your website and profile offline at any time from the Plan page in your account, and we do not hide that option. If you want your account permanently deleted, you ask us from that same page and a person reads the request. When we act on it, a 30-day wait starts before anything is removed, so a decision made in a hard moment is not immediately final: you can change your mind at any point in those 30 days. After them, your data is purged from our systems for good, which is why we make that deadline clear to you before it arrives, not after.

We can also close an account, but only for a real reason: a serious or repeated breach of these terms, or where the law requires it. Except in cases of serious harm or abuse, we will tell you why and give you a chance to put it right first. We do not close accounts to make a number look better on a spreadsheet.

Either way, you can delete your content at any time. If you would like a portable copy of your work, contact us at support@artsites.me and we will put one together for you.

9. Limitation of liability

We work hard to keep ArtSites reliable, but we cannot promise it will be perfect, and the law lets us limit what we are responsible for when something goes wrong. To the extent the law allows, ArtSites is not liable for indirect losses, such as a lost sale or a missed opportunity, that follow from using ArtSites. Nothing here limits responsibility that the law never lets us limit, such as harm caused by our own gross negligence. If you are ever unsure what this means for your situation, ask us; we would rather explain it in plain language than have you guess.

10. Changes to these terms

We may update these terms as ArtSites changes. When we do, we update the date at the foot of this page, and if a change is significant, we tell you directly, by email or a notice in your account, rather than expecting you to check back on your own. Continuing to use ArtSites after a change takes effect means you accept it. If a change is one you cannot accept, you can close your account before it takes effect, and everything in the Termination section above applies to you exactly as it would otherwise.

11. Governing law

These terms are governed by the laws of British Columbia, Canada. If a dispute between us ever needs to go to court, it is heard in the courts of British Columbia.
